By accessing and registering at the ElectricFM.com VIP Club website and Rewards Program, you are agreeing to all of the terms and conditions as outlined below. Please read carefully.

By registering and/or using the ElectricFM
VIP Rewards Program ("EFM"), you agree that you have read and understand the Terms of Service ("TOS") and that your membership with EFM conforms with the TOS stated below.
When joining EFM, you become a Member of our rewards program. Members can earn points for taking advantage of select point-earning opportunities on the EFM website. Opportunities include, but are not limited to, listening to the ElectricFM station, taking surveys, watching videos, signing up at a website, online shopping, receiving Paid Email, and referring others to the EFM program. Members of EFM are not "employees" of EFM. Membership is provided free and on a voluntary basis.
EFM is under no obligation to provide our members with any minimum or maximum amount of point earning opportunity offers. We make no promises or guarantees in the amount of points that you can earn in our program. We may Email our members from time to time with news and information relevant to your EFM membership. These Emails are not Paid Emails and members will not be rewarded for receiving such Emails unless otherwise stated in the mailing. You can opt-out of receiving these mailings at anytime by canceling your EFM account.
In order to join EFM, you must be at least eighteen (18) years of age. We only accept users from the United States and Canada. Users from all other countries are prohibited from joining EFM. Members are limited to one account per person, and one (1) account per household. Multiple accounts will be flagged as fraud, and our systems will notify us of this situation to make sure the member is following the TOS. If EFM finds a user with multiple accounts, we reserve the right to terminate all said accounts, and all points will be forfeited. We also may ask for photo identification faxed to us to prove each member's account. Failure to comply will force EFM to terminate all accounts involved. Upon termination, all points earned are void and cannot be redeemed. Any pending redemptions will not be processed. A member whose account is terminated for fraud abuse is prohibited from rejoining our site at a later date.
As a member of EFM, you agree not to abuse EFM. This includes, but is not limited to, using multiple accounts, attempting to earn points through cheating and/or fraudulent methods, and tampering with the links used in order to improperly earn points on EFM. All offers on EFM are to be completed one-time only unless otherwise stated in the offer. EFM reserves the right to terminate any EFM Member's account if EFM believes that the member has violated any part of this agreement. As a result of termination for the TOS violation, all points are forfeited immediately, and the member can no longer earn or spend points on EFM. EFM will be the sole determiner in deciding if a EFM member's account violated this agreement. All account terminations are final and irreversible.
Points Expiration. Points earned on the EFM VIP Rewards Program expire six (6) months after the month in which they were earned, if they were not used to request a redemption item beforehand. For example, points earned in the month of January will be expired on August 1st. You must redeem your points before the 6 month expiration, otherwise the points will be forfeited once they expire.
Account Inactivity. You must earn at least 1 point within a twelve (12) month period. If you fail to earn at least 1 point in a twelve month period, your account will be canceled by the system for being inactive. New members must also confirm their E-Mail address before gaining access to the VIP Members Area. If a member does not validate their E-Mail address after one month, the account will automatically be canceled. Accounts deleted for inactivity will lose all points earned, and points will not be reinstated.
Lost points. If Member completes an offer which is automatic tracking (no confirmation is asked to be forwarded to EFM for cedit) EFM is under no obligation to credit Member if transaction is not in EFM Merchant Reports. If a transaction is not within EFM's merchant reports, EFM was not paid for the transaction. You hereby hold EFM harmless in all missing point situations and EFM is not obligated to provide Member with points for which EFM was not paid for. Reasons for transactions not in EFM Reports include, but are not limited to: ad-blocking software, cookies not set to Medium or lower, images disabled, previously signed up for offer elsewhere, EFM's Link not used, etc.
Shopping Transactions. EFM posts shopping points to accounts within one month after the Member's order ships. Upon redemption, EFM will verify that said purchase was in fact completed using EFM's link. If Member completes a Shopping Transaction, but later returns the item, applies an invalid coupon code or created an invalid order or Merchant reports to EFM that Member did not use EFM's Link, EFM reserves the right to reverse all points awarded on the particular transaction. If EFM's merchant reports are adjusted to a different amount than originally credited to Member, EFM will adjust Member's account to match EFM Merchant Reports.
Direct linking to sponsors of EFM is strictly prohibited. Direct linking is defined as linking direct to a sponsor to collect points, without actually viewing the banner ad before you click on it or clicking on a link to collect points that did not originate from the EFM website. Members found to be using outside links will be terminated for fraud abuse. Using the EFM website with images off to earn points is prohibited. In order to be properly credited for your actions, you must have images on at all times to ensure proper crediting. Failure to do so will cause our systems to not credit your account if our software detects you have images off, and will alert us of this situation.
If EFM finds an account being used in fraudulent methods, the account will be immediately terminated at EFM's sole discretion and all points will be forfeited immediately. Any redemption requests for the fraudulent account not processed at the time of termination will be voided. EFM reserves the right to take proper legal action against the member for the losses and damages that resulted out of the fraudulent behavior on the EFM website. EFM reserves the right to ask you for ID to prove your identity after you redeem your points. This is in an effort to combat users making multiple accounts with false information. Our advertisers only want true, valid leads to their sites and fraud hurts not only them, but us too. If asked to send in a form of ID to us, you can send a copy of your driver's license or EFMedit card statement. You should black out any personal information such as account numbers, driver's license number, etc. as we only want to see your name and address to confirm your identity.
You can redeem your earned points on rewards listed under the Spend Points link in the Member's Area. Points do not have a cash value and cannot be transferred or sold. EFM reserves the right to limit the number of available rewards at any time for any point redemption section. Upon redeeming your points, your points will be set to pending until your redemption is verified and processed. Each redemption is verified to ensure the Member did not violate any parts of this agreement as well as verify all transactions against EFM Merchant Reports to ensure EFM was properly credited for each transaction. Once you redeem your points for a reward, you cannot change and/or cancel your redemption. All redemption requests are final.
International Fraud. EFM does not allow members from any International country. The only permitted users on EFM are from the United States and Canada. Any member found to be located outside of these two countries will have their account immediately terminated and all points forfeited. If after redeeming for a reward, and your IP address is from a country from other than your member information shows, the redemption will be void due to providing fraudulent user information.
Member agrees to keep all personal information on file with EFM up to date and true. If a member needs to change any of their information, such as Email address, they can do so in our Member's Area. If EFM sends Member a reward which is returned by the post office for an invalid mailing address, EFM will assess a fee of 20,000 points to resend the reward to Member with the proper mailing address.
EFM does not allow members to Spam. If a EFM member sends Spam, we immediate terminate their EFM account and points will be immediately forfeited. Spam is strictly prohibited.
Use of the EFM website is provided on an "as-is" basis with no warranties. Use of the EFM website is at the member's risk. EFM makes no warranties of any kind for interrupted services, software glitches, or human error. EFM cannot be held responsible for damages and/or losses that can result from using the EFM Rewards Program. EFM is not responsible and has no liability for changes or discontinuation of services from providers that may affect offers and/or the acEFMual of points on EFM. EFM will not be liable for any damages whether direct, indirect, incidentally, or accidentally through members participation on EFM.
EFM assumes no liability for any part in participation on our advertisers and sponsor websites. Member understands that there can be a delay in the crediting of member accounts for completed offers and/or shopping through the EFM website. Advertisers provide EFM with reporting information that is used to credit all valid transactions to accounts. EFM will not be held responsible or liable for the delays or failures to credit accounts in such an event that the advertiser fails to provide EFM with proper reporting information. If the advertiser fails to properly report various transactions to EFM, EFM is not responsible for any lost points that can arise from the particular situation. EFM shall not be liable for any damages and/or losses that can result from participating on the EFM website.
A member can terminate their EFM account at any time for any reason. A member can access the Close Account link within the Member's Area of the website or can E-Mail feedback (at) ElectricFM.com with their cancellation request and EFM will promptly terminate the member's account. Upon termination, all points are void and the member can no longer earn or spend points on EFM. The member understands that after termination, they may still receive messages from EFM that may have been scheduled for delivery prior to the account termination. Member will not receive points or compensation for the receipt of such messages after termination.
If a member disagrees with any part of this TOS agreement, Member must immediately terminate their membership using the termination method above. If a Member is not completely satisfied with the EFM website, the member can cancel their account with EFM.
This contract shall be governed in accordance with the laws of the State of New Jersey. If any provision of this agreement is invalid or unenforceable, then the provision will be enforced to the fullest extent allowed by law, and all other provisions will remain in full force and effect.
